Casa Kalā — Where Every Gift Tells a Story
Last updated: 16 October 2026
1. About These Terms
Welcome to Casa Kalā. Throughout this website, the terms “Casa Kalā”, “we”, “us” and “our” refer to Casa Kalā, the business offering curated hampers, bespoke gifting, handmade products, corporate gifts, event favours and bulk gifting services.
By accessing our website, contacting us to enquire about our products, or placing an order, you agree to the terms that apply to your use of our website and services.
Please read these Terms & Conditions carefully before placing an order. If you have any questions, please contact us at enquiry@casakala.com.au.
These terms are subject to applicable Australian laws, including the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any rights that cannot legally be excluded.
2. Our Products and Services
Casa Kalā specialises in thoughtfully curated and customised gifts, including:
* Bespoke and ready-made hampers.
* Handmade resin products and decorative items.
* Brass and other homeware or gifting accessories.
* Festive and religious gifting.
* Wedding, engagement, birthday and baby shower favours.
* Corporate gifting, real estate gifting and client appreciation gifts.
* Bulk orders, return gifts and event gifting.
Product availability, quantities, colours, designs, packaging and personalisation options may vary depending on stock, suppliers, materials and the nature of the order.
Some products are handmade or assembled individually. Minor variations in colour, texture, finish, placement and appearance may occur. Such variations are part of the handmade process and do not automatically indicate a product defect.
We will endeavour to describe and photograph our products accurately.
3. Product Images and Descriptions
We make every reasonable effort to ensure that product photographs, descriptions and prices are accurate.
However, colours and finishes may appear differently depending on your screen settings, lighting and display device.
Where a product contains handmade components, natural materials or individually sourced items, minor variations may occur.
If a particular colour, item, size, material or design is essential to your order, please confirm the specification with us in writing before payment.
Any material substitution for a confirmed custom order will be discussed with the customer before proceeding.
4. Customised and Bespoke Orders
Custom orders are prepared according to the customer’s agreed requirements, budget, quantity, occasion, personalisation and design preferences.
Before confirming a custom order, we may request information such as:
* Your budget per gift or total budget.
* Required quantity.
* Occasion and preferred style.
* Personalisation, colours and packaging preferences.
* Required delivery date and destination.
A quotation will outline the agreed products, quantity, price and other relevant details.
A custom order is confirmed when Casa Kalā has accepted the order and the agreed payment or deposit requirements have been met.
Customers are responsible for checking names, spelling, dates, messages, logos, colours and other supplied details before approving final artwork or personalisation.
Changes requested after approval may incur additional costs or affect production and delivery timelines.
We will advise you if a requested change is no longer reasonably possible.
5. Quotations, Pricing and Payments
All prices will be communicated in Australian dollars unless otherwise stated.
Prices may vary according to material costs, supplier pricing, product availability, customisation, packaging, quantity and delivery requirements.
A quotation is valid for the period stated in that quotation. If no validity period is specified, please confirm the price with us before proceeding if there has been a significant delay.
Unless otherwise agreed in writing, the quoted price applies only to the items, quantities and specifications included in the quotation.
Delivery charges, special packaging, personalisation, rush production and other additional services will be disclosed where applicable.
For bespoke, corporate and bulk orders, payment may be required in advance or in agreed instalments. Any deposit, balance payment and due dates will be stated in the quotation or invoice.
Production will generally commence once the required payment, order details and approvals have been received.
An order is not guaranteed until Casa Kalā has confirmed acceptance.
6. Corporate, Event and Bulk Orders
Corporate gifting and bulk orders may require advance planning, sourcing, personalisation and production.
Customers should provide the correct quantity, branding assets, recipient details and required delivery date when requesting a quotation.
Production and delivery timeframes will be communicated based on the order requirements and availability of materials.
For large orders, we may recommend a sample or reference approval before full production. Any sample fees and approval requirements will be confirmed in advance.
Once a customer approves the specifications, changes to quantities, packaging, materials, artwork or delivery arrangements may affect the final price and timeline.
For orders requiring multiple deliveries or individual recipient addresses, additional charges may apply and will be communicated before confirmation.
7. Order Changes and Cancellations
We understand that circumstances can change. Please contact us as soon as possible if you need to amend or cancel an order.
Custom orders may involve purchasing materials, preparing artwork, reserving stock, personalising products and commencing handmade production shortly after confirmation.
Any cancellation or change will be assessed according to the stage of the order, the work completed, materials already purchased, supplier commitments and applicable law.
Where a cancellation or change is accepted, any amount payable or refundable will be determined fairly, taking account of applicable legal requirements and the circumstances of the order.
We will explain any applicable charges before finalising an agreed change or cancellation, where reasonably practicable.
Nothing in this section removes any refund, cancellation or other remedy available to a customer under Australian Consumer Law.
8. Delivery, Collection and Delays
Delivery options, estimated timeframes and applicable charges will be communicated during the ordering process or in the relevant quotation.
Delivery dates are estimates unless a specific date has been expressly agreed in writing.
We will make reasonable efforts to meet agreed timeframes. However, delays can occur because of courier disruptions, supplier delays, stock availability, weather, transport issues or other circumstances outside our reasonable control.
If we become aware of a material delay, we will communicate the revised timeframe as soon as reasonably practicable and discuss available options where appropriate.
Customers must provide an accurate delivery address, contact number and any necessary delivery instructions.
Please ensure someone is available to receive the order where a signature or safe delivery arrangement is required.
Additional charges may apply for redelivery or address changes requested after dispatch, where applicable.
For collection orders, the agreed collection arrangements will be communicated directly to the customer.
Our delivery terms do not exclude any rights a customer may have if an order is not delivered within an agreed or legally required timeframe.
9. Packaging and Fragile Items
We take reasonable care when preparing and packaging our gifts.
Some products, including glassware, ceramic items, resin decorations and other fragile components, require careful handling during transport.
Customers should inspect their order promptly after delivery and contact us as soon as possible if an item appears damaged, incorrect or missing.
Please retain the original packaging and take clear photographs of any visible damage to help us assess the issue and, where relevant, communicate with the delivery provider.
We will assess reported issues and provide an appropriate remedy where required by law.
A customer is not required to surrender any statutory consumer rights because original packaging is unavailable.
10. Returns, Refunds and Consumer Guarantees
We want our customers to be happy with their Casa Kalā purchases.
If an item is faulty, damaged, incorrectly supplied, not as described or otherwise fails to meet an applicable consumer guarantee, please contact us at enquiry@casakala.com.au.
Depending on the circumstances and the rights available under Australian Consumer Law, a customer may be entitled to a repair, replacement, refund, cancellation or other remedy.
Customised or personalised products are not automatically excluded from consumer guarantees.
Where a product has been made correctly according to the agreed specifications and the customer simply changes their mind, our voluntary change-of-mind return policy may not provide a refund or exchange. Any such policy will be communicated before purchase.
Nothing in these terms limits or excludes rights or remedies that cannot legally be excluded under Australian Consumer Law.
Please contact us with your order details, a description of the issue and supporting photographs where relevant so we can assess the matter.
11. Handmade Products and Product Care
Some Casa Kalā products are handmade, hand-finished or individually assembled.
Minor differences in finish, colour, texture, decorative placement or appearance may occur between individual pieces.
These variations do not automatically constitute a fault where the item otherwise matches its description and agreed specifications.
Customers should follow any care instructions supplied with the product.
Resin decorations, brass items, glassware, candles and other homeware products may require different handling and care. Unless specifically stated, decorative items should not be assumed to be food-safe, heatproof, dishwasher-safe or suitable for direct contact with food.
Please follow the product-specific instructions and warnings provided.
12. Personalisation, Names and Customer-Supplied Content
Customers are responsible for providing accurate spelling, names, dates, messages, logos and other personalisation details.
We may request written approval of designs, proofs or artwork before production.
Once approval has been provided, any requested correction or alteration may affect cost and delivery time.
Customers must ensure they have permission to use any logo, photograph, artwork, trademark or other material they supply to Casa Kalā.
We reserve the right to decline content that is unlawful or infringes another person’s rights.
13. Intellectual Property
Unless otherwise stated, the content on this website, including Casa Kalā branding, logos, product photographs, original designs, written descriptions, videos and marketing materials, is owned by Casa Kalā or used with permission.
You may not copy, reproduce, distribute, modify, commercially exploit or republish our original content without prior written permission, except where permitted by law.
Purchasing a product does not transfer ownership of our intellectual property.
Customers retain any rights they hold in materials they provide to us. By supplying material for an order, customers permit us to use it only as reasonably necessary to prepare, produce and fulfil that order, subject to any separate agreement.
14. Customer Photographs, Reviews and Marketing
We appreciate customer feedback and photographs featuring Casa Kalā products.
We will not assume that purchasing a product or sending us a photograph gives us unrestricted permission to publish the customer’s name, image, testimonial or private correspondence.
Where we wish to use customer-provided content for marketing, we will seek permission where required and clarify the intended use.
Any permission granted will be subject to the agreed scope and applicable law.
15. Website Use
You agree to use our website lawfully and not to:
* Use the website for fraudulent or unlawful purposes.
* Interfere with the security or operation of the website.
* Introduce malicious code or attempt unauthorised access.
* Copy or exploit website content without permission.
* Submit false, misleading or unlawful information.
* Use our website in a way that infringes the rights of others.
We may restrict access to website features where reasonably necessary for security, maintenance, legal compliance or misuse prevention.
16. Third-Party Services and Links
Our website may use third-party services for website hosting, payment processing, delivery, analytics, marketing and other business functions.
External links may direct you to websites that are not operated by Casa Kalā.
We do not control independent third-party websites and encourage customers to review their relevant terms and privacy policies.
This section does not exclude any responsibility that Casa Kalā has under applicable law.
17. Privacy and Personal Information
We may collect information such as your name, contact details, delivery address, order details and personalisation instructions when you enquire about or purchase our products.
We use this information to respond to enquiries, process orders, arrange delivery, provide customer service and carry out other disclosed business purposes.
Our handling of personal information is described in our Privacy Policy, available through our website.
We take reasonable steps to handle personal information appropriately and securely, subject to applicable legal requirements.
18. Website Information, Errors and Availability
We endeavour to keep our website, product descriptions, pricing and availability information accurate and current.
Occasionally, errors or omissions may occur.
If a material pricing, description or availability error affects an order, we will contact the customer to discuss an appropriate way forward. We will not rely on a website error to remove rights that a customer has under applicable law.
We may update website content, introduce new products or discontinue products from time to time.
Any changes affecting an already confirmed order will be handled in accordance with the agreed order terms and applicable law.
19. Liability
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot legally be excluded under Australian law.
To the extent permitted by law, Casa Kalā is not responsible for loss arising solely from a customer’s failure to provide accurate order details, follow supplied care instructions or comply with agreed delivery arrangements.
This section does not exclude liability where such exclusion would be unlawful, including any liability that cannot legally be excluded under Australian Consumer Law.
20. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes in our business, services, website or legal obligations.
The latest version will be published on our website with its updated date.
The terms applicable to a confirmed order will be determined by the agreement with the customer and applicable law. Publishing a revised version does not automatically change an existing order agreement.
21. Governing Law
These Terms & Conditions are governed by the laws applicable in Victoria, Australia, together with applicable Commonwealth laws.
Nothing in these terms prevents a customer from exercising rights available under applicable consumer protection legislation.
